The fair use doctrine in India is defined under Section 52 of the Copyright Act, 1957. It permits unlicensed use of copyrighted material for specific purposes—including private research, criticism/review, news reporting, and education—provided the usage is fair, acknowledged, and does not compete with the original work.
Permitted Purposes: Under Section 52(1)(a) of the Copyright Act, permitted uses include:
Private or Personal Use: Includes research.
Criticism or Review: Academic or artistic commentary.
Reporting Current Events: Including reporting lectures in public.
Education: Use by teachers or students in classroom instruction.
AMF ‘s organisational stance on the use of publicly delivered speeches by figures of national importance within our musical compositions are as follow:
a) Monetization: As a Section 8 non-profit NGO, any royalties collected through our online labels/artist are handled in strict accordance with the Companies Act, which ensures that royalties cannot be distributed as dividends or profits to members. You may note that all earnings must be exclusively reinvested into the organization’s educational objectives by sustaining and expanding its educational music catalogue across all digital platforms—including websites, audio streaming, and social media.
b) Transformation: While the vocal speeches remain recognisable to preserve the integrity of the message, their placement within a musical arrangement is transformative. This creative context provides a new medium for the author’s message, ensuring a positive impact and wider reach without portraying any individual negatively.
c) Intent: As outlined in our constitutional documents, our focus is solely on providing educational content aligned with our mission. The primary intent is the dissemination of knowledge and values.
d) Attribution: We maintain a policy of radical transparency. We provide full credit to the original speakers across all platforms, including digital metadata, descriptions, and social media communications.
AMF may or may not own the rights to the vocals clip used in any (or one) of the songs from the discography. They have, in accordance with fair use, been repurposed with the intent of educating and inspiring others.
